“When you apply for a personal loan, the creditor will check your credit report to help them determine whether you will repay the debt,” says Rod Griffin, director of public education for Experian, one of the three major credit bureaus. “Your credit history and credit scores help lenders predict the likelihood a person will repay a debt as agreed upon.”

Research for the Illinois Department of Financial and Professional Regulation found that a majority of Illinois payday loan borrowers earn $30,000 or less per year.[16] Texas' Office of the Consumer Credit Commissioner collected data on 2012 payday loan usage, and found that refinances accounted for $2.01 billion in loan volume, compared with $1.08 billion in initial loan volume. The report did not include information about annual indebtedness.[17] A letter to the editor from an industry expert argued that other studies have found that consumers fare better when payday loans are available to them.[18] Pew's reports have focused on how payday lending can be improved, but have not assessed whether consumers fare better with or without access to high-interest loans. Pew's demographic analysis was based on a random-digit-dialing (RDD) survey of 33,576 people, including 1,855 payday loan borrowers.[19]

These scams involve a company claiming that they can guarantee you a loan if you pay them a processing fee, an application fee or pay for ‘insurance’ on the loan in advance. The company will advertise on the Internet, in the classified section of a newspaper or magazine, or in a locally posted flyer. They will sometimes use a legitimate company’s name or use a variant of a trusted name. They will sometimes ask you to call them at a "900" number, which will result in charges to your phone bill. They will usually ask to be paid via overnight or courier service or by wire, so that they can’t be traced. In order to avoid being taken in by this scam you should be aware that:

The likelihood that a family will use a payday loan increases if they are unbanked or underbanked, or lack access to a traditional deposit bank account. In an American context the families who will use a payday loan are disproportionately either of black or Hispanic descent, recent immigrants, and/or under-educated.[15] These individuals are least able to secure normal, lower-interest-rate forms of credit. Since payday lending operations charge higher interest-rates than traditional banks, they have the effect of depleting the assets of low-income communities.[22] The Insight Center, a consumer advocacy group, reported in 2013 that payday lending cost U.S communities $774 million a year.[23]

In calculating finance charges under this subsection, when the first installment period is longer than the remaining installment periods, the amount of the finance charges applicable to the extra days shall not be greater than $15.50 per $100 of the original principal balance divided by the number of days in a regularly scheduled installment period and multiplied by the number of extra days determined by subtracting the number of days in a regularly scheduled installment period from the number of days in the first installment period. 

Some states have laws limiting the number of loans a borrower can take at a single time according to LATimes report.[18] This is currently being accomplished by single, statewide realtime databases. These systems are required in Florida, Michigan, Illinois, Indiana, North Dakota, New Mexico, Oklahoma, South Carolina, and Virginia States Statues.[19] These systems require all licensed lenders to conduct a real time verification of the customer's eligibility to receive a loan before conducting a loan. Reports published by state regulators in these states indicate that this system enforces all of the provisions of the state's statutes. Some states also cap the number of loans per borrower per year (Virginia, Washington), or require that after a fixed number of loan renewals, the lender must offer a lower interest loan with a longer term, so that the borrower can eventually get out of the debt cycle by following some steps. Borrowers can circumvent these laws by taking loans from more than one lender if there is not an enforcement mechanism in place by the state. Some states allow that a consumer can have more than one loan outstanding (Oklahoma).[20] Currently, the states with the most payday lenders per capital are Alabama, Mississippi, Louisiana, South Carolina and Oklahoma.[21]
Payday loans are marketed towards low-income households, because they can not provide collateral in order to obtain low interest loans, so they obtain high interest rate loans. The study found payday lenders to target the young and the poor, especially those populations and low-income communities near military bases. The Consumer Financial Protection Bureau states that renters, and not homeowners, are more likely to use these loans. It also states that people who are married, disabled, separated or divorced are likely consumers.[56] Payday loan rates are high relative to those of traditional banks and do not encourage savings or asset accumulation. This property will be exhausted in low-income groups. Many people do not know that the borrowers' higher interest rates are likely to send them into a "debt spiral" where the borrower must constantly renew.

People from all walks of life generally use their payday loan for emergency expenses, including doctor bills, utility payments, rent payments, or to avoid bouncing a check (or checks) at their financial institution. The fees associated with a payday loan can often be the most affordable option for a customer who may otherwise encounter NSF fees from the bank or late fees on a credit card.

Sometimes you can't catch up on bills as they pile up. Many companies consider an account in default if you exceed several months without making arrangements or catching up on missed bills. Some businesses work with collection agencies to try to recover any owed money. When that happens, you might see a collection notation on your report. Collections may remain on your account after you pay them off, but if a lender manually looks at your report, they can see your steps toward financial responsibility.


Payday loans have a bad reputation, and in fact many people refer to these loans as “predatory lending.” Twelve states have even banned payday loans altogether. Caution should be taken when considering obtaining these types of loans, which often “rollover” or are extended when they can’t be repaid in time and result in additional extension fees and an overall larger repayment amount. Because of the risk, payday loans should only be used in emergency situations when you know you can pay the loan back in full on time. If you do not borrow, you could end up in more debt.

In US law, a payday lender can use only the same industry standard collection practices used to collect other debts, specifically standards listed under the Fair Debt Collection Practices Act (FDCPA). The FDCPA prohibits debt collectors from using abusive, unfair, and deceptive practices to collect from debtors. Such practices include calling before 8 o'clock in the morning or after 9 o'clock at night, or calling debtors at work.[32]
In practice, the current system of state-level regulation imposes significant costs on states that seek to control payday lending to their residents. These restrictive states must expend resources to monitor attempts by out-of-state lenders, particularly the growing number of online lenders, to extend loans to their residents in violation of state law. Online lenders have a long reach, straining the law enforcement resources of restrictive states.
When you have bad credit, obtaining new credit can be challenging. People with bad credit often find it difficult to get approved for a loan, as there is a limited number of lenders that offer bad credit loans. When people with bad credit are approved for a loan, there are typically higher interest rates, more fees and greater restrictions than personal loans for people with good credit.

A 2012 report produced by the Cato Institute found that the cost of the loans is overstated, and that payday lenders offer a product traditional lenders simply refuse to offer. However, the report is based on 40 survey responses collected at a payday storefront location.[43] The report's author, Victor Stango, was on the board of the Consumer Credit Research Foundation (CCRF) until 2015, an organization funded by payday lenders, and received $18,000 in payments from CCRF in 2013.[44]


Finding a loan is tough when you have less-than-perfect credit, especially when the minimum credit requirement set by a bank puts a conventional loan out of your reach. Short-term options like payday loans can be a big help when you’re facing an emergency expense, but you’ll want to make sure you know exactly how much it’s costing you before you sign on the dotted line.
By examining payday loan prices in each state from the four largest lenders, Pew found that over five months a $300 payday loan would cost an Ohio borrower $680 in interest and fees, which equals an average annual percentage rate of 591 percent (which is close to the 594 percent figure cited by Cordray.) No other state had a higher rate, according to the Pew analysis. The interest and fees amount in Ohio was slightly exceeded by Texas, but Texas has more protections for consumers, including a 180-day loan limit that Ohio doesn’t have.
