The ads are on the radio, television, the Internet, even in the mail. They refer to payday loans, cash advance loans, check advance loans, post-dated check loans, or deferred deposit loans. The Federal Trade Commission, the nation’s consumer protection agency, says that regardless of their name, these small, short-term, high-rate loans by check cashers, finance companies and others all come at a very high price.


This is made easier for the lender when the people payday lenders usually serve are right on the edge; the average payday loan is made to cover an unforeseen expense of just a few hundred dollars. Many people would be able to absorb that expense in some fashion even if it cost them some interest carrying a credit card balance, but someone asking for a payday loan is likely facing eviction or repossession for want of that relatively small amount of money. However, if such a small fiscal bump can derail their financial life to that degree, what does that say about their ability to amortize this amount of money, especially when the "fees" for each individual 2-4 week payday loan (which because the lenders specifically avoid the term "interest" or "finance charge" on the paperwork, can be far in excess of any rate limits imposed on non-banks) are very often more than the person can pay in one month?
After permitting high-cost payday loans, New Hampshire capped payday loan rates at 36 percent annual interest in 2009.  Montana voters passed a ballot initiative in 2010 to cap loan rates at 36 percent annual interest, effective in 2011.  South Dakota voters approved a ballot initiative in 2016 by a 75 percent vote to cap rates for payday, car title and installment loans at 36 percent annual interest.  Arizona voters rejected a payday loan ballot initiative in 2008, leading to sunset of the authorizing law in 2010.  North Carolina tried payday lending for a few years, then let the authorizing law expire after loans were found to trap borrowers in debt.  The states of Connecticut, Maryland, Massachusetts, Pennsylvania, Vermont, and West Virginia never authorized payday loans.  The District of Columbia repealed its payday law.
U.S. News researched lenders for data on eligibility, loan terms, fees, repayment methods and additional features to identify the best companies offering bad credit personal loans. The analysis was limited to companies with online applications, no minimum FICO credit score or a minimum FICO score of 620 or less, and a maximum debt-to-income ratio of at least 40 percent, with preference for companies offering features including cosigners and online preapprovals.

In a perfect world, you could rely on a credit card to cover emergency expenses. But, as you might have already guessed, most Americans don’t have that kind of available credit on hand to use either. In fact, according to a Harvard University study, nearly 40 percent of households making less than $40,000 a year have no credit cards at all.2 And one in ten Americans have no credit score whatsoever!3

In a profitability analysis by Fordham Journal of Corporate & Financial Law, it was determined that the average profit margin from seven publicly traded payday lending companies (including pawn shops) in the U.S. was 7.63%, and for pure payday lenders it was 3.57%. These averages are less than those of other traditional lending institutions such as credit unions and banks.

No lender may make a payday loan to a consumer if the total of all payday loan payments coming due within the first calendar month of the loan, when combined with the payment amount of all of the consumer's other outstanding payday loans coming due within the same month, exceeds the lesser of: (1) $1,000; or (2) in the case of one or more payday loans, 25 percent of the consumer's gross monthly income; or (3) in the case of one or more installment payday loans, 22.5 percent of the consumer's gross monthly income; or (4) in the case of a payday loan and an installment payday loan, 22.5 percent of the consumer's gross monthly income.
A 2012 study by Pew Charitable research found that the majority of payday loans were taken out to bridge the gap of everyday expenses rather than for unexpected emergencies. The study found that 69% of payday loans are borrowed for recurring expenses, 16% were attributed to unexpected emergencies, 8% for special purchases, and 2% for other expenses.[57]
Notwithstanding any other provision of law, no check cashing business licensed under this article shall directly or indirectly charge or collect fees for check cashing services in excess of the following: (a) Three percent of the face amount of the check or $5, whichever is greater, for checks issued by the federal government, state government, or any agency of the state or agency of the state or federal government, or any county or municipality of this state; (b) Ten percent of the face amount of the check or $5, whichever is greater, for personal checks; or (c) Five percent of the face amount of the check or $5, whichever is greater, for all other checks, or for money orders.
Any installment payday loan must be fully amortizing, with a finance charge calculated on the principal balances scheduled to be outstanding and be repayable in substantially equal and consecutive installments, according to a payment schedule agreed by the parties with not less than 13 days and not more than one month between payments; except that the first installment period may be longer than the remaining installment periods by not more than 15 days, and the first installment payment may be larger than the remaining installment payments by the amount of finance charges applicable to the extra days.
To give you an idea of how difficult this category of borrower is to deal with, you had General Electric doing personal loans to these sort of customers based on healthy returns and VERY high interest rates (I went past there when I was working and it started at 33%). There is just one small problem with that, being high risk borrowers they were also the most likely to DEFAULT and never pay their loans back. 

Brian Melzer of the Kellogg School of Management at Northwestern University found that payday loan users did suffer a reduction in their household financial situation, as the high costs of repeated rollover loans impacted their ability to pay recurring bills such as utilities and rent.[46] This assumes a payday user will rollover their loan rather than repay it, which has been shown both by the FDIC and the Consumer Finance Protection bureau in large sample studies of payday consumers [11][15][47]
This reinforces the findings of the U.S. Federal Deposit Insurance Corporation (FDIC) study from 2011 which found black and Hispanic families, recent immigrants, and single parents were more likely to use payday loans. In addition, their reasons for using these products were not as suggested by the payday industry for one time expenses, but to meet normal recurring obligations.[15]
This scam, like the advance fee loan scam, uses the internet, phone and newspaper to advertise. A company claims that they can guarantee a grant or loan from the government in exchange for a fee. Victims are instructed to send money to pay for ‘insurance’ on the promised grant or loan. They will usually ask that the money be sent via overnight or courier services or by wire, so that they don’t leave any trace of their identity or location. They then provide the victim with information that is available in any library or can be ordered directly from the government.
Whoever came up with short term payday loans, cash loans, whatever you want to call it - they came up with a wonderful idea. They knew that bad things really could happen to good people. Some examples of why one may need to take out short term loans could be: sudden loss of a job and short of rent/mortgage payment, car loan got slightly behind due to some unexpected repairs you paid for, or what if you air conditioner went out in your home dead smack in the summer - the cash loans that are really easy to get made a nightmare into a really good dream and one that can really come true.

(a) Instead of the charges authorized by §§342.201 and 342.252, a loan made under this subchapter with a maximum cash advance computed under Subchapter C, Chapter 341, using a reference base amount that is more than $100 but not more than $200, may provide for: (1) an acquisition charge that is not more than $10; and (2) an installment account handling charge that is not more than the ratio of $4 a month for each $100 of cash advance.
