A licensee may charge the customer a service fee for each deferred presentment service transaction. A service fee is earned by the licensee on the date of the transaction and is not interest. A licensee may charge both of the following as part of the service fee, as applicable: (a) An amount that does not exceed the aggregate of the following, as applicable: (i) 15 percent of the first $100 of the deferred presentment service transaction. (ii) 14 percent of the second $100 of the deferred presentment service transaction. (iii) 13 percent of the third $100 of the deferred presentment service transaction. (iv) 12 percent of the fourth $100 of the deferred presentment service transaction. (v) 11 percent of the fifth $100 of the deferred presentment service transaction. (vi) 11 percent of the sixth $100 of the deferred presentment service transaction. (b) The amount of any database verification fee allowed under §34(5).
These scams involve a company claiming that they can guarantee you a loan if you pay them a processing fee, an application fee or pay for ‘insurance’ on the loan in advance. The company will advertise on the Internet, in the classified section of a newspaper or magazine, or in a locally posted flyer. They will sometimes use a legitimate company’s name or use a variant of a trusted name. They will sometimes ask you to call them at a "900" number, which will result in charges to your phone bill. They will usually ask to be paid via overnight or courier service or by wire, so that they can’t be traced. In order to avoid being taken in by this scam you should be aware that:
To prevent usury (unreasonable and excessive rates of interest), some jurisdictions limit the annual percentage rate (APR) that any lender, including payday lenders, can charge. Some jurisdictions outlaw payday lending entirely, and some have very few restrictions on payday lenders. In the United States, the rates of these loans used to be restricted in most states by the Uniform Small Loan Laws (USLL), with 36–40% APR generally the norm.
A licensee may charge and receive on each loan interest at a simple annual rate not to exceed 36 percent. A licensee may charge and receive a loan fee in an amount not to exceed 20 percent of the amount of the loan proceeds advanced to the borrower. A licensee may charge and receive a verification fee in an amount not to exceed $5 for a loan made under this chapter. The verification fee shall be used in part to defray the costs of submitting a database inquiry as provided in subdivision B 4 of §6.1-453.1.
In the US, payday lenders are regulated and illegal in some places. In fact, one of the reasons you see the 1000% interest rates is that lenders are required to prominently display this information. Banks like this, because it often leads to overdraft fees, and the lenders like this because it gives them direct access to the borrower's funds so they can continue collection efforts until paid in full, including any late charges and interest. However, federal laws provide that borrowers should be able to revoke these automatic withdrawal privileges or close the account, regardless of whether the loan is still outstanding, though man borrowers have found this very difficult to do.

As for federal regulation, the Dodd–Frank Wall Street Reform and Consumer Protection Act gave the Consumer Financial Protection Bureau (CFPB) specific authority to regulate all payday lenders, regardless of size. Also, the Military Lending Act imposes a 36% rate cap on tax refund loans and certain payday and auto title loans made to active duty armed forces members and their covered dependents, and prohibits certain terms in such loans.
A staff report released by the Federal Reserve Bank of New York concluded that payday loans should not be categorized as "predatory" since they may improve household welfare. "Defining and Detecting Predatory Lending" reports "if payday lenders raise household welfare by relaxing credit constraints, anti-predatory legislation may lower it." The author of the report, Donald P. Morgan, defined predatory lending as "a welfare reducing provision of credit." However, he also noted that the loans are very expensive, and that they are likely to be made to under-educated households or households of uncertain income.
Some lenders may use credit score along with other factors for loan consideration. An example is the FICO scoring system — which ranges from 300 to 850 — to gauge the likelihood of a borrower repaying a loan. Scores below 620 often fall into the “bad credit” range, which makes it difficult for those people to borrow from lenders that only use FICO to determine loan eligibility.
